Terms and Conditions

1. Welcome to FLAGG

Remember when being active was just fun? Running, jumping, climbing. Then responsibilities pile up and staying active starts to feel like work. FLAGG is here to simplify that.

By creating an account or using FLAGG, you agree to these Terms, our Privacy Policy, and our Cookie Policy. If you do not accept these Terms, please do not use the service.

2. Our Mission

  • Motivate: help you discover relevant places to stay active.
  • Reward: recognize your contributions and engagement.
  • Protect: keep the platform useful, safe, and respectful.

3. Eligibility and Minimum Age

FLAGG is intended for users aged 14 and older. By using the service, you confirm you are at least 14 years old. If you are between 14 and 17, you must have obtained permission from a parent or legal guardian.

4. Platform Use

You agree to provide accurate information, respect other members, and use FLAGG in good faith.

  • No harassment, threats, spam, or hateful content.
  • No identity theft or attempts to disrupt the service.
  • No illegal, misleading, or rights-infringing content.

5. Account Suspension and Termination

FLAGG reserves the right to suspend or terminate an account, without prior notice, in case of a violation of these Terms, abusive behavior, or a risk to platform or member safety.

You may delete your account at any time. Deletion and purging of personal information is handled in accordance with the Privacy Policy.

6. User-Generated Content

You remain responsible for what you post (reviews, comments, reports, plans, photos).

Photos posted in places, reviews, and reports are public. By uploading content, you represent and warrant that you hold all required rights (copyright, image rights, required authorizations) over each uploaded element. You agree to indemnify FLAGG against any third-party claim arising from a violation of those rights.

Reviews and comments represent the personal opinion of their author. FLAGG does not endorse, validate, or take responsibility for these opinions.

FLAGG may moderate, remove, or limit content that violates these Terms, its policies, or applicable law. FLAGG reserves the right to evaluate any reported content and decide whether to keep or remove it according to its policies, without any obligation to automatically remove content upon request.

7. Reporting and Rights Claims

To report abusive, unlawful, or policy-violating content, use the reporting form available on the platform or write to allo@flagg.ca.

For any copyright or image rights claim, send a notice to allo@flagg.ca specifying: (1) precise identification of the disputed content, (2) the nature of your rights over that content, (3) your full contact details. FLAGG will acknowledge receipt, evaluate the request, and act in accordance with applicable law, including the Canadian Copyright Act.

8. License Granted to FLAGG on Content

You retain your rights in your content. However, you grant FLAGG a non-exclusive, worldwide, transferable, sublicensable, royalty-free license, for the duration needed to fulfill the stated purposes, to host, reproduce, adapt, display, distribute, and promote that content in order to operate, improve, secure, and market the platform.

9. FLAGG Intellectual Property

The FLAGG brand, logo, interface, text, and editorial content are protected by intellectual property laws. No use of these elements is permitted without our prior written consent.

10. Physical Activities, Personal Safety, and Public Plans

FLAGG provides information about physical activity venues for informational purposes only. FLAGG is not the operator, manager, or responsible party for these venues. FLAGG does not guarantee the safety, accessibility, condition of facilities, or practice conditions at the time of your visit.

You assume full responsibility for your physical activities, risk assessment, and your fitness to engage in an activity at a given venue. In the event of an accident, injury, or incident occurring at a venue listed on FLAGG, FLAGG cannot be held liable.

Plans and activities posted by users are information shared voluntarily and publicly. FLAGG cannot guarantee the safety of meetings or activities organized through the platform. We recommend using your judgment and taking customary precautions when meeting strangers. If you organize or participate in an activity planned through FLAGG, you are responsible for your arrangements and your safety.

11. Platform Data Sources

Venue data comes primarily from user contributions on the platform. FLAGG may also incorporate data from open public sources (for example: open government data, OpenStreetMap © OpenStreetMap contributors, ODbL license) or from third-party sources under contractual agreements. FLAGG does not guarantee the accuracy of this data and disclaims all liability for errors or omissions.

Any automated extraction (scraping, crawling, harvesting) of FLAGG content or data by third parties is prohibited without prior written agreement from FLAGG.

12. Aggregated and De-identified Data

FLAGG may use aggregated or de-identified data for analytics, service improvement, performance research, usage measurement, and development of commercial or partner offerings.

13. Communications and Partners

FLAGG may make certain data available to service providers and partners under controlled contractual terms, in line with the Privacy Policy and applicable laws.

Any communication sent through the platform is identified as coming from FLAGG or as sent on behalf of FLAGG, including communications related to partner programs.

14. Commercial Offers, Pricing, and Service Evolution

Certain features may become paid or subject to a commercial plan. FLAGG may modify, add, or remove features, pricing, plans, or usage limits, with at least 30 days' notice for any change affecting existing features.

15. Corporate Transaction

In the event of a merger, acquisition, reorganization, financing, asset sale, or similar transaction, platform-related information and content may be transferred, subject to applicable legal requirements.

16. Limitation of Liability and Indemnification

FLAGG hosts user content as a technical intermediary and does not participate in its creation. FLAGG is not responsible for opinions, reviews, information, or content posted by users.

FLAGG provides its platform as is, without express or implied warranties regarding accuracy, continuous availability, or fitness for a particular purpose. You use the service at your own risk.

To the extent permitted by law, FLAGG will not be liable for indirect, consequential, incidental, or punitive damages arising from your use of or inability to use the service, accidents or incidents occurring at listed venues, or incidents arising from activities organized through the platform.

You agree to indemnify and hold FLAGG harmless from any liability arising from your content, your use of the service, or your violation of these Terms or any third-party rights.

17. Changes

We may update these Terms. For significant changes, we will notify you by email and through a banner on the platform, at least 15 days before they take effect. Continued use after that date constitutes acceptance of the updated Terms.

18. Governing Law and Jurisdiction

These Terms are governed by the laws in force in Quebec, Canada. Any dispute related to these Terms will be subject to the exclusive jurisdiction of the courts of Quebec.

19. Entire Agreement

These Terms, the Privacy Policy, and the Cookie Policy constitute the entire agreement between you and FLAGG regarding your use of the service.
